The new Housing Rent Adjustment Index (IRAV), implemented by the National Statistics Institute (INE), has been criticised by various actors in the real estate market. This index, which replaces the CPI as a reference for the annual update of rental rents, stands at 2.28% for December 2024.

The IRAV ‘is not really an index that reflects the reality of the market and therefore discourages the rental market and the generation of more supply’. Carroza argues that the index’s methodology responds to ‘political and not professional’ criteria, which could worsen the overall rental situation in Spain.

Furthermore, the coexistence of two different references for updating rents – the IRAV for contracts signed after the Housing Law of May 2023 and the CPI for previous ones – generates confusion and legal insecurity among landlords. This duality could further discourage the supply of rental housing in a market already strained by high demand and limited availability.

Instead of imposing rates that could distort the market, it would be advisable to take measures that reinforce legal certainty for landlords, such as the creation of a housing court, which could streamline procedures and mediate between tenants and landlords, and to opt for measures that do not create insecurity for landlords, In addition, incentives and reductions in the ITP and VAT taxes should be offered for the construction of more homes for rent, in order to increase the supply and allow the market itself to control prices in a sustainable way.

In summary, although the intention of the IRAV is to protect tenants from excessive rent increases, its implementation could have counterproductive effects by discouraging landlords and reducing the supply of rental housing. It is essential to consider solutions that balance tenant protection with appropriate incentives for landlords, thus fostering a more stable and accessible rental market for all.
