Do you need someone else to act on your behalf to carry out a procedure, sign a document or represent you before a government body? If so, you may need a power of attorney.

This is a document authorised by a solicitor through which one person, known as the principal, grants another, known as the attorney, the authority to act on their behalf within the limits set out. It is a very useful legal tool when you cannot attend in person, when you live in another city or country, or when you prefer to delegate certain tasks to someone you trust or to a professional.

What do you need to do to grant a power of attorney?

Drawing up a power of attorney is generally a straightforward process. The usual procedure involves the following steps:

1. Decide what you need to delegate

This is a special power of attorney frequently used in property transactions. It allows another person to sign on your behalf in a sale or purchase. With this type of power of attorney, it is advisable to define the agent’s scope of action very precisely.

Power of attorney for inheritance matters

This is used to accept, manage, allocate or even sell inherited assets on behalf of the principal. It is common when one of the heirs is unable to travel or wishes to delegate these matters.

Power of attorney for personal or administrative matters

Powers of attorney may also be granted for matters such as:
