What is a DAFO, why is it necessary and when should it be performed?

WHAT IS THE DAFO?

The DAFO is a document issued by the Town Hall which certifies that the property cannot be subject to penalties or demolition and offers maximum security to the buyer. It basically regulates the legal situation of rustic properties that do not have a licence of first occupation and that are built or modified after 1975.

If you have made any changes to the property since you bought it (for example, you have built a garage or a swimming pool), these have to be registered and regulated.

IT IS THE SELLER’S RESPONSIBILITY TO OBTAIN THE DAFO

The simplest way to explain it is that DAFO stands for: Declaration Assimilated Out of Order.

The idea is to have a record of the actual date of anything that has been built on the property, how many years have passed since construction and to certify that the property has been accepted as legal and that there will be no future fines. Please note that it will not be possible to extend or build further once the DAFO has been obtained.

Here are some of the requirements of the DAFO and how to obtain them, and of course we will be happy to help you. The price may vary according to the value of the property.

A certificate must be carried out by a recognised architect or technician. Any elements built since you bought the property must be included in the plan and also the architect must certify that the septic tank complies with the regulations.

It will be the architect who, after carrying out the necessary measurements and paperwork, will submit the project to the Town Hall and then the Town Hall architect will visit the property to ensure that it complies with the requirements.

The property must have a new style septic tank, not a cesspit.

The time to complete this procedure can be from 6 to 18 months.

IF THE SWOT IS NOT DONE PRIOR TO THE SALE, A PRE-SALES SWOT CAN BE DONE AND THE FINAL COSTS WILL BE RETAINED FROM THE PURCHASE PRICE.

In some cases, it will be impossible to obtain a SWOT on a property for certain reasons that are beyond the control of the sellers simply due to the change in laws in recent years. In this case it is still possible to sell the property, but as the buyers are taking a risk, they are likely to make a much lower offer.

To obtain a mortgage for a rural property most banks will insist that the property has a DAFO certificate.
